  Bureau of Natural Resources and Planning,Yantai(as the Sponsor)is currently holding the“International Solicitation of Proposals for Strategic Upgrading and Urban Design of Zhifu Bay,Yantai”Design agencies worldwide with related planning design experience are publicly invited to participate and submit the Prequalification Application Documents.The Sponsor will select six final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

  項目規(guī)模：空間結(jié)構(gòu)規(guī)劃，范圍約50平方公里；控制性詳細規(guī)劃深度城市設(shè)計，范圍約10平方公里（陸域）；修建性詳細規(guī)劃深度城市設(shè)計，范圍約2.2平方公里。

  Project size:Space structure planning,covering a scope of approximately 50 square kilometers;in-depth urban design of regulatory plan,with the planned land area of approximately 10 square kilometers;in-depth urban design of site plan,with the design scope of approximately 2.2 square kilometers.

  設(shè)計任務(wù)：本次征集范圍包含三個空間層次：一是芝罘灣及其周邊地區(qū)約50平方公里，包括芝罘島、煙臺港、幸福新城等區(qū)域，主要開展空間結(jié)構(gòu)、生態(tài)景觀、功能組團、交通體系等梳理整合工作；二是芝罘灣地區(qū)，東至芝罘灣海域，西至環(huán)海路，南至北馬路，北至芝罘島東路，約10平方公里（陸域），開展控規(guī)深度城市設(shè)計；三是一、二突堤，約2.2平方公里，開展修建性詳細規(guī)劃深度的城市設(shè)計和重要建筑的概念方案設(shè)計。

  Design tasks:The solicitation includes three spatial levels:Firstly,Zhifu Bay and its surrounding areas,approximately 50 square kilometers,including Zhifu Island,Yantai Port,Xingfu New Town,mainly involving the organization and integration of spatial structure,ecological landscapes,function clusters,transportation system,etc.;Secondly,Zhifu Bay area,including Zhifu Bay sea area in the east,Huanhai Road in the west,Beima Road in the south,and Zhifu Island East Road in the north,approximately 10 square kilometers(land area),mainly involving in-depth urban design of regulatory plan;Thirdly,the first and second jetties,approximately 2.2 square kilometers,involving the in-depth urban design of site plan and conceptual design of key buildings.

  4.應(yīng)征申請人的資格

  4.Eligibility and Qualifications of Applicants

  4.1應(yīng)征申請人（以下簡稱“申請人”）應(yīng)為合法注冊的法人實體或由合法注冊的法人實體組成的項目聯(lián)合體。不接受個人及個人組合的報名。

  4.1 Any Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.Individual or team of individuals will not be accepted.

  4.2申請人須具有城鄉(xiāng)規(guī)劃/城市設(shè)計的專業(yè)技術(shù)能力。

  4.2 Applicants shall have professional and technical abilities in urban and rural planning or urban design.

  4.2.1中華人民共和國境內(nèi)的申請人應(yīng)提供能證明其具有承擔城鄉(xiāng)規(guī)劃或城市設(shè)計的專業(yè)技術(shù)能力的證明材料（如原城鄉(xiāng)規(guī)劃編制資質(zhì)證書、外商投資企業(yè)城市規(guī)劃服務(wù)資格證書或城鄉(xiāng)規(guī)劃/城市設(shè)計的委托合同等）或建筑行業(yè)（建筑工程）設(shè)計甲級及以上資質(zhì)。

  4.2.1 The Applicants within the People's Republic of China shall provide certification materials proving that they have the professional and technical abilities to undertake the urban and rural planning or urban design,such as a qualification certificate for the urban and rural planning,a Certificate of Qualification of Foreign-funded Enterprises for Urban Planning Services,or a commission contract of urban and rural planning/urban design,etc.;or the qualification certificate of Grade A architectural design(architectural engineering)or above.

  4.2.2中華人民共和國境外的申請人須依本國或本地區(qū)的管理規(guī)定具有城鄉(xiāng)規(guī)劃或城市設(shè)計或建筑設(shè)計的執(zhí)業(yè)許可或經(jīng)營許可。港澳臺設(shè)計機構(gòu)的資格要求參照境外設(shè)計機構(gòu)資格要求的規(guī)定。

  4.2.2 The Applicants outside the People's Republic of China should have a practice license or business license for urban and rural planning or urban design or architectural design in accordance with the national or local administrative regulations.The qualification requirements for design agencies in Hong Kong,Macao and Taiwan should refer to the provisions on the qualification requirements for overseas design agencies.

  4.3本項目接受聯(lián)合體應(yīng)征。

  4.3 The Consortium is accepted in this Project.

  4.4除聯(lián)合體內(nèi)部的成員外，參加征集的應(yīng)征人之間不應(yīng)存在關(guān)聯(lián)關(guān)系。

  4.4 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.

  有意向參加應(yīng)征的申請人需先在北京科技園拍賣招標有限公司網(wǎng)站（www.bkpmzb.com）下載資格預(yù)審文件領(lǐng)取登記表，填寫完成后以Word版本E-mail至征集指定郵箱kjysanbu 163.com或遞交至北京科技園拍賣招標有限公司，征集組織機構(gòu)收到登記表后，再將資格預(yù)審文件的下載密碼發(fā)送給申請人。

  申請文件遞交的截止時間為2021年8月22日下午17時00分，申請人應(yīng)在遞交截止時間之前將申請文件遞交至征集組織機構(gòu)。主辦單位和征集組織機構(gòu)將拒絕接收逾期送達的申請文件。

  The deadline for submission of application documents is 17:00 a.m.on Aug 22,2021.Applicants shall submit such documents to the Organizer of Solicitation.The Sponsor and the Organizer of Solicitation will reject any such documents that arrive after the specified deadline.

  8.1知識產(chǎn)權(quán)

  8.1 IP(Intellectual Property)Rights

  8.1.1本次方案征集接收的所有有效的應(yīng)征文件均不退回。

  8.1.1 All response proposals received in this solicitation will not be returned.

  8.1.2應(yīng)征人對其應(yīng)征設(shè)計文件享有署名權(quán)，在征得主辦單位書面同意后可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示其應(yīng)征設(shè)計文件的相關(guān)內(nèi)容。除應(yīng)征人的設(shè)計標準、設(shè)計導(dǎo)則和繪圖元素以外，應(yīng)征人不得將應(yīng)征設(shè)計文件及設(shè)計成果用于其他的設(shè)計項目。

  8.1.2 The Participant holds the right of authorship for its Design Proposal and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s consent in writing.Participant shall not use the design documents and Design Proposals on other design projects,except the Participant’s design standards,design guides and principles,and drawing elements.

  8.1.3本次征集活動的應(yīng)征規(guī)劃和城市設(shè)計文件和設(shè)計成果的知識產(chǎn)權(quán)由主辦單位與應(yīng)征人共同享有。

  8.1.3 The intellectual property rights(IPRs)of the Design Proposals and design results in this solicitation shall be commonly owned by the Sponsor and the Participants.

  8.1.4應(yīng)征人應(yīng)保證提交的應(yīng)征設(shè)計文件及設(shè)計成果在中國境內(nèi)或境外沒有且不會侵犯任何其他人的知識產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如果其應(yīng)征設(shè)計文件使用或包含任何其他人的知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人應(yīng)已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔。

  8.1.4 Participants shall ensure that all the submitted application documents and Design Proposals have not infringed upon and will not infringe upon IPR(including but not limited to copyright,patent right and trademark right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.Participants shall guarantee that if their Design Proposals use or include IPR or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participant shall take all liabilities for any compensations arising from infringement upon IPR or know-how or trade secrets of others.

  8.1.5主辦單位有權(quán)在本項目的規(guī)劃或城市設(shè)計中使用應(yīng)征人提交的規(guī)劃和城市設(shè)計成果，主辦單位在項目的規(guī)劃設(shè)計中或在規(guī)劃設(shè)計方案調(diào)整綜合時可以全部或部分使用應(yīng)征規(guī)劃和城市設(shè)計成果的內(nèi)容，也可以對其進行修改。主辦單位不得將應(yīng)征設(shè)計文件及設(shè)計成果用于本項目以外的其他項目。

  8.1.5 The Sponsor has right to use the submitted planning and design results by the Participant in the planning or urban design of this Project and while the Sponsor prepare the planning design or adjust and integrate the planning design proposals for this Project,the Sponsor can use the planning proposals and urban design results in its entirety or partially and can also make modifications.The Sponsor shall not use the Design Proposals and design results for a purpose other than this Project.

  8.1.6主辦單位可以對所有應(yīng)征設(shè)計文件及設(shè)計成果印刷、出版和展覽，并可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價、展示、宣傳應(yīng)征設(shè)計文件及設(shè)計成果，但應(yīng)注明設(shè)計機構(gòu)的名稱。

  8.1.6 The Sponsor can also print,publish and exhibit all proposals for response,or comment on,display and publicize the design proposals and design results via media communications,trade magazines,publications or by other means.The precondition is indication of the name of design institutions for such planning and design.

  8.1.7應(yīng)征建筑設(shè)計方案（如果有）的著作權(quán)歸屬于應(yīng)征人。建筑設(shè)計方案使用權(quán)轉(zhuǎn)讓事宜另行協(xié)商。

  8.1.7 The copyright of architectural design proposals(if any)shall belong to the Participants.The transfer of the right to use the architectural design proposal shall be negotiated separately.

  8.2應(yīng)征設(shè)計補償金

  8.2 Compensations for Designs Proposals

  主辦單位將向按征集文件的要求在規(guī)定的時間內(nèi)提交了有效應(yīng)征文件的應(yīng)征人支付應(yīng)征設(shè)計補償金，金額為人民幣270萬元（含稅）。當應(yīng)征人出現(xiàn)下列情況時，主辦單位不予支付補償金：

  The Sponsor will pay compensations for Designs Proposals to Participants who have submitted valid application documents in accordance with the solicitation document requirements.The amount is RMB 2.7 million(including tax).The Sponsor will not pay any compensation when Participants are under the following circumstances:

  (1)應(yīng)征人未按規(guī)定時間提交應(yīng)征文件；

  (1)Participants fail to submit the application documents within the specified time;

  (2)應(yīng)征人提交的應(yīng)征文件經(jīng)專家委員會評審被認定為未對征集文件要求作出實質(zhì)性響應(yīng)；

  (2)The application documents submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the solicitation documents;

  (3)應(yīng)征人被取消應(yīng)征資格。

  (3)Participants are disqualified.

  8.3獎項和深化費用的設(shè)置

  8.3 Awards and deepening fee settings

  本次方案征集設(shè)優(yōu)勝獎2名，獲優(yōu)勝獎的2個應(yīng)征人須根據(jù)主辦單位的深化設(shè)計要求對其提交的設(shè)計成果進行為期45天的深化優(yōu)化，深化費用為每家人民幣300萬元（含稅）。

  There will be two winners in this solicitation.The two winning Participants shall deepen and improve their design results for 45 days according to the in-depth design requirements of the Sponsor.The deepening fee for each participant is RMB 3.0 million(including tax).

  8.4征集后續(xù)工作：優(yōu)勝方案的應(yīng)征人可能被邀請參加本項目控制性詳細規(guī)劃的編制和研究工作，具體的事宜另行協(xié)商。

  8.4 Follow-up work for the solicitation:The winning Participants may be invited to participate in the preparation and research of the regulatory detailed plan of the Project.Specific matters will be negotiated separately.

  8.5適用法律

  8.5 Governing Laws

  本次征集活動本身及與本次活動相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國的法律和法規(guī)。

  The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.

  8.6語言

  8.6 Languages

  資格預(yù)審文件以及與資格預(yù)審文件相關(guān)的補充文件和澄清文件均使用中文和英文書寫。申請文件應(yīng)使用中文書寫，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語言，但應(yīng)附中文譯本。在中文與其他語言的意思表達不一致時，以中文為準。

  The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English.In the case of inconsistent expressions in both Chinese and other language,the Chinese version shall prevail.Application Documents for Prequalification shall be drafted in Chinese.Another language can be used for the proof documents that the Applicant provides along with the Application Documents and printed documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and other language,the Chinese version shall prevail.

  8.7解釋權(quán)

  8.7 Power of Interpretation

  本次征集活動的最終解釋權(quán)歸主辦單位。

  The Sponsor reserves the power of final interpretation in view of the solicitation.
